O artigo tem por objetivo promover a discussão sobre o Decreto n. 9.571, de 21 de novembro de 2018, que estabelece as Diretrizes Nacionais sobre Empresas e Direitos Humanos para médias e grandes empresas. A análise é baseada em dois aspectos, os quais demonstram a ilegitimidade e insuficiência do mencionado decreto para fazer face às graves violações aos direitos humanos decorrentes de atividades empresariais no país: i) a ausência de participação social em sua elaboração; ii) o caráter não vinculante de suas disposições.
This paper aims to discuss Decree n. 9.571/2018, which establishes the National Guidelines on Business and Human Rights for medium and large business enterprises. The analysis is based on two aspects, which demonstrate the illegitimacy and insufficiency of the aforementioned decree to address the serious human rights violations resulting from business activities in Brazil: (i) the lack of social participation in the development of Decree n. 9.571/2018 and (ii) the non-binding nature of its provisions.
