O presente trabalho tem por objetivo discutir os impactos do desenvolvimentismo na América Latina e as possíveis respostas jurídico-políticas advindas da busca pela efetivação dos direitos socioambientais e da ideia de buen vivir vinda do Constitucionalismo Latino-Americano. Para chegar a esta finalidade, o texto é desenvolvido com base em três objetivos específicos: a) apresentar genericamente os problemas ambientais decorrentes das atividades humanas, em especial, aqueles relacionados à ideia desenvolvimentista; b) destacar os prejuízos desta lógica para a América Latina, e c) trazer reflexões sobre as contribuições possíveis quanto ao reconhecimento e efetivação dos direitos socioambientais e quanto ao buen vivir, enquanto parâmetro para nortear as relações entre natureza e sociedades. O método utilizado é o dialético, buscando tratar o tema pela tríade tese-antítese-síntese, com o fim de trazer uma crítica à situação abordada e lançando luz sobre novas possibilidades de superação. Como conclusão, encontram-se aportes sobre as necessidades de criar novos modelos jurídico-políticos que possam colaborar na construção de alternativas frente aos problemas ambientais observados na sociedade hodierna.

This paper aimed to analyze the impacts of developmentalism in Latin America and the possible legal-political responses arising from the search for the effectiveness of socio-environmental rights and the idea of “buen vivir” coming from Latin American Constitutionalism. To achieve this purpose, the text is developed based on three specific objectives: a) to present generically the environmental problems arising from human activities, in particular, those related to the developmentalist idea; b) highlight the losses of this logic for Latin America, and c) bring reflections on the possible contributions regarding the recognition and realization of socioenvironmental rights and regarding the “buen vivir”, as a parameter to guide the relations between nature and societies. The method used is the dialectic, seeking to treat the theme by the triad thesis-antithesissynthesis, in order to bring a criticism to the situation addressed and shedding light on new possibilities of overcoming. In conclusion, there are contributions on the needs to create new legal-political models that can collaborate in the construction of alternatives in view of the environmental problems observed in today’s society.
