Este trabalho busca analisar as técnicas de decisão adotadas pelo Tribunal Constitucional Federal Alemão, uma vez que a Lei 9868/99, em seu art.27, que diz respeito á mitigação dos efeitos retroativos do juÃzo a respeito da inconstitucionalidade normativa, recebeu inspiração dos expedientes tedescos por intermédio dos trabalhos doutrinários empreendidos pelo membro da comissão elaboradora do anteprojeto que se converteu na Lei 9868/99, hoje ministro do STF, Gilmar Mendes.

This paper seeks to analyze the techniques of decision adopted by the German Federal Constitutional Court, since the Law 9868/99, in its art. 27, that concerning the retroactive effect to mitigation of judgment about the rules unconstitutional, received inspiration from tedescos expedients through the doctrinal work undertaken by the member of the commission setting-up the bill which became the Law 9868/99, now minister of STF, Gilmar Mendes.
