Conteúdo da palestra ministrada no Curso de Iniciação dos Magistrados, organizado pela Escola de Magistratura do Rio de Janeiro (EMERJ), na sede do Tribunal de Justiça, no Rio de Janeiro, em 28 de abril de 2015. O autor aborda a judicialização da saúde a partir de um ponto de vista contrário ao habitual, tentando identificar o caminho a percorrer para uma desjudicialização, isto é, uma retração do aumento da quantidade de ações judiciais sobre o direito à assistência terapêutica em curso no país, a qual quadriplicou, de 100.000 para 400.000 demandas aproximadamente entre 2010 e 2014. Considerando que o efeito mais perverso da judicialização da saúde reside na ruptura da universalidade do acesso às prestações de saúde, com o surgimento de dois SUS, um em favor dos que demandam judicialmente e outro em favor dos que não demandam, o texto busca soluções, ora imputando à Administração a responsabilidade pela observância dos direitos fundamentais e não apenas da literalidade das leis e dos regulamentos, ora estimulando a judicialização das políticas da saúde, como uma pretensão restrita aos processos coletivos e como a alternativa – factível no momento - para combater as demandas repetitivas ante um SUS que ainda não despertou para as garantias de um verdadeiro dueprocess of law, a despeito da sua previsão constitucional e legislativa.

Contents of the lecture given in the Initiation Course for Judges, organised by the EMERJ (School of Judicial Science of Rio de Janeiro), at the Court of Justice in Rio de Janeiro on 28 April 2015. The author takes an unconventional approach to the question of judicial review of health care by trying to identify the path that will lead to reducing such judicial review, i.e., a reversal of the current growth trend in the number of Brazilian court cases involving the right to therapeutic assistance, which has quadrupled in the past 4 years from approximately 100,000 claims in progress in 2010 to 400,000 in 2014. Considering that the most perverse effect of judicial review of health is the resulting disruption in the universality of access to health care services, with the creation of two SUS (unified health-care systems”), one of them in favour of those who file court claims and the other favouring those who do not, the text searches for solutions. The author in some cases holds the public authorities responsible should be oriented towards the supremacy of fundamental rights and not by the literal interpretation of the statutes and regulations, at in other cases encourages judicial review of health policies but only through class actions as a currently feasible alternative to fight against the repetitive claims filed with the SUS, which has not yet realised the need for guarantees of true due process of law even though such guarantees are called for by the Constitution and applicable statutes.
