Contemporaneamente, como resultado do processo histórico de avanços e retrocessos políticos, existem vários arranjos institucionais que, desde a doutrina judicialista, pretendem conciliar interdependência e harmonia entre os Poderes constituídos na criação e significação do direito. Entre as muitas correntes ideológicas opostas ao poder revisional exclusivo das Cortes de Justiça, destaca-se a teoria do Diálogo Institucional. Esse complexo sistema de controle de constitucionalidade foi considerado por autores como Peter Hogg e Alison Bushell como uma invenção única no mundo jurídico, sendo mais reconhecidamente adotado no constitucionalismo canadense. Nesse contexto, o presente estudo analisa a evolução teórico-histórica da teoria dos Diálogos Institucionais a partir das contribuições de Ronald Dworkin, John Hart Ely e Jeremy Waldron sob os influxos do constitucionalismo norte americano.

Nowadays, as a result of the historical process of political advances and setbacks, there are various institutional arrangements that, from the judicialist doctrine, seek to reconcile interdependence and harmony among the Powers constituted in the creation and signification of law. Among the many ideological currents opposed to the exclusive judicial review powers, the Institutional Dialogue theory stands out. This complex system of constitutionality control was considered by authors such as Peter Hogg and Alison Bushell as a unique invention in the legal world, being more widely adopted in the Canadian constitutionalism. In this context, the present study analyzes the theoretical-historical evolution of the Institutional Dialogue from the contributions of Ronald Dworkin, John Hart Ely and Jeremy Waldron under the inflows of American constitutionalism.
