O artigo analisa, sob enfoque sistêmico e perspectiva histórica, a diferenciação interna do subsistema jurÃdico-penal. Busca-se descrever, especialmente a partir dos casos francês e inglês, a diferenciação entre direito e polÃtica e posterior diferenciação do sistema jurÃdico. Na diferenciação interna do subsistema jurÃdico-penal, os casos analisados sugerem diferentes trajetórias na divisão do trabalho jurÃdico-penal. Analisa-se, também, a diferenciação entre administração pública e sistema de justiça e a distinção entre organizações incumbidas da persecução penal e as diferentes atribuições assumidas.
Resumo Inglês:
The article analyses, from a systemic and historical approach, the internal differentiation of the criminal subsystem. It identifies, especially from the French and British experiences, the differentiation of law and politics and the subsequent differentiation of the law system. The British and French cases suggest different process in the division of the penal work. It also analyses the differentiation of the public administration and the justice system and the distinction among the organizations in charge of the penal persecution and the different tasks.
