O objetivo deste trabalho foi analisar as raízes da dignidade da pessoa humana para que se possa demonstrar a inserção desta no constitucionalismo contemporâneo como direito fundamental de comando estruturante do Estado, bem como estudar a dignidade da pessoa humana à luz da contenda dos direitos sociais, em especial o direito ao mínimo existencial. Os recursos utilizados na contemporaneidade tem feito o homem mergulhar em profunda crise existencial, estando cada vez mais coisificado e descartável, dando-lhe assim uma obstrução de concretizar sua potencialidade enquanto physis e telus. Por isso se faz válido uma análise do mínimo existencial em seu caráter negativo, no sentido minimalista das prestações estatais aos que delas necessitam, tentando quebrar assim com a concepção consolidada de existencialidade mínima da pessoa. No fim, constitui-se uma análise filosófica existencial sobre o tema, realçando a infrutífera prestação do Estado para com a contemplação do desenvolvimento humano, tentando assim aproximar direito, moral, política e ação humana, para que o homem não perca o seu real sentido nem suas potencialidades.

The objective of this work is analyse the roots of human being’s dignity to demonstrate the insertion of this dignity in the contemporary constitucionalism as fundamental right of structuring rule of the State, as well as study the human being’s dignity from the light of the social rights strife, specially the right to the existencial minimum. The resources used on the contemporarity has made men submerge into a deep existencial crises, been ever more reified and disposable, making a obstruction to concretize his potenciality as physis and telus. Therefore is valid an analysis of existencial minimum by his negative character, in the minimalist meaning of the benefits by the states to the people who needs, trying to break with the consolidated conception of the existencial minimum of the person. Ultimately, is constituted a existential philosofical analyses about this theme, enhancing the unfruitful benefits of the State to the contemplation of the human development, trying by this way aproximate Law, Moral, Politics and human action, so that the human being do not lose his real meaning and potencialities.
