Para tratar do delicado e importantíssimo tema que é a dignidade da pessoa humana, deve-se antes de tudo esclarecer a direção em que se pretende seguir. O fato de se pretender caminhar sob a luz da fenomenologia heideggeriana não deve obscurecer a intenção aqui exposta. Trata-se de uma discussão no seio do Direito. Com isso quer-se dizer que se buscam dialogar e resolver problemas ligados diretamente à práxis jurídica. A pergunta acerca do que seja dignidade da pessoa humana não pode se voltar para o campo abstrato, mas deve ter como horizonte questionador o acontecer do Direito, a sua facticidade. O desvelamento fenomenológico heideggeriano deve, portanto, fazer emergir a dignidade a um contato mais próximo do que efetivamente aquela seja, ao contrário de perder a discussão em questões que ao Direito importariam apenas indiretamente.

To address the delicate and important subject, which is the human dignity, we must fi rst of all clarify the direction it is going. Th e fact that if you want to walk in the light of Heideggerian phenomenology should not obscure the intent outlined here. Th is is a discus-sion within the law. With this it is meant that seek to dialogue and solve problems directly related to the practice of law.The question about what is human dignity cannot return to the abstract field, but should have as a goal of law questioning the place, its facticity. The unveiling Heidegger phenomenology must therefore bring out the dignity in closer contact than that actually is, instead of losing the debate on issues that the law would matter only indirectly.
