O presente artigo tem como escopo realizar um estudo comparado acerca do direito ao esquecimento no Brasil e no âmbito geral da União Europeia. A metodologia utilizada foi dedutiva, junto de um método comparativo e técnica de análise documental. Para tanto, delimitar-se-á a natureza jurídica do direito ao esquecimento e sua possível colisão com a liberdade de expressão. Após, passar-se-á expor sua base legal no ordenamento e aplicação pelos tribunais brasileiros, realizando, posteriormente, o mesmo no âmbito da comunidade europeia. Ao final, em sede de conclusão, resumir-se-á de modo comparativo o direito ao esquecimento no Brasil e na União Europeia, no qual foi possível colher um resultado que demonstra o atraso no âmbito jurídico brasileiro em relação à União Europeia.
The purpose of this article is to perform a comparative study on the right to be alone in Brazil and European Union. The methodology used was deductive, together with a comparative method and technique of documentary analysis. To this purpose, will reflect about the legal nature of the right to be alone and its possible collision with freedom of expression. Afterwards, it will begin to present its legal basis in the planning and application by the Brazilian courts, and will subsequently carry out the same in the European community. At the end, in conclusion, the right to be alone in Brazil and European Union will summarized in a comparative manner, picking up a result that demonstrates the delay in the Brazilian legal framework in relation to the European Union.
