O presente estudo pretende lançar mão de reflexões doutrinárias principalmente vinculadas à modernidade e ao positivismo jurídico para introduzir questionamentos acerca da relação entre política e direito especialmente na atuação de cortes e tribunais internacionais. A estrutura de coordenação internacional contraposta à subordinação interna convida à análise do direito sob as perspectivas de sua eficácia e efetividade. Poderiam política e direito cooperar garantindo normatividade ao direito internacional? A partir de instrumental teórico selecionado busca-se, dedutivamente, fixar parâmetros ao questionamento para, indutivamente, encontrar propostas que pretendem auxiliar o debate sem esgotar o tema.
This paper intends to use reflections mainly related to modernity and to the legal positivism to introduce questions on the relationship between politics and law, especially on international courts and tribunals. The international power structure based on coordination, when opposed to its subordination shape internally observed, requires the analysis of law under the perspective of its effectiveness - both as to indicate the applicable law and as to grant effectiveness itself. Could politics and law cooperate by ensuring normativity in international law? From selected theoretical instruments, it is sought, deductively, to set parameters for the questioning to inductively find proposals that intend to help the debate without exhausting the subject.
