RESUMO O objetivo do presente trabalho consiste em analisar as diferenças, semelhanças e limites da interpretação constitucional e da intepretação conforme a Constituição. Para tanto, o trabalho aborda conceitos fundamentais de hermenêutica e Direito, para posteriormente adentrar a hermenêutica constitucional. A metodologia adotada foi composta pelo método de abordagem dialético comparativo, uma vez que se buscou uma conclusão a partir do debate entre diversas posições teóricas, e pelo procedimento da pesquisa bibliográfica, apresentando-se autores selecionados conforme a temática proposta. Como conclusão apontou-se o melhor caminho para a hermenêutica jurídica, em especial a hermenêutica constitucional.

ABSTRACT The purpose of this paper is to analyze the differences, similarities and limits of Law, constitutional interpretation and interpretation according to the Constitution. For this, this paper approaches fundamental concepts of hermeneutics and Law, later to enter the constitutional hermeneutics. The methodology adopted was composed by the method of comparative dialectical approach, considering that the conclusion was sought from the debate between several theoretical positions, and by the procedure of the bibliographic research, presenting selected authors according to the proposed theme. As a conclusion this paper pointed out the best path to juridical hermeneutics, especially constitutional hermeneutics.
