RESUMO O objetivo deste artigo é fundamentar a necessidade das garantias dos direitos das culturas para a legitimidade das sociedades democráticas contemporâneas profundamente caracterizadas pelo acelerado processo de globalização. A discriminação e a exclusão são incompatíveis com os direitos humanos, especificamente, o princípio da dignidade humana e a expressão da identidade cultural. Contudo, as sociedades não podem desconsiderar os valores, a convivência com as tradições culturais e os valores, hábitos e formas de comunicação com caráter universal. O problema que nos orienta é: a diversidade cultural é compatível com a democracia e a garantia dos direitos fundamentais? A fundamentação desta exposição é feita a partir da reflexão filosófico jurídica atual e contemplando decisões dos tribunais. Afirma-se que a concretização dos direitos das culturas é essencial para o fortalecimento da democracia, dos direitos humanos e da convivência tolerante entre os povos.

ABSTRACT The purpose of this article is to substantiate the need for the guarantees of the rights of cultures for the legitimacy of contemporary democratic societies deeply characterized by the accelerated process of globalization. Discrimination and exclusion are incompatible with human rights, specifically the principle of human dignity and the expression of cultural identity. However, societies can not disregard values, coexistence with cultural traditions and values, habits and forms of communication with a universal character. The problem that guides us is: is cultural diversity compatible with democracy and the guarantee of fundamental rights? The basis of this exposition is based on current legal philosophical reflection and contemplating court decisions. It is said that the realization of cultural rights is essential for the strengthening of democracy, human rights and tolerant coexistence among peoples.
