A incorporação pelo Poder Judiciário do discurso popular punitivista, a partir de revisão bibliográfica, é o foco central do presente artigo. Para tanto, busca-se apontar as funções do Poder Judiciário e, especificamente, do sistema de justiça criminal, além de observar se estas são cumpridas no cotidiano do sistema. Indicam-se as razões que importaram no protagonismo do Judiciário a partir da década de 1980 no Brasil, e como este fenômeno influenciou a atuação do Poder Judiciário. Evidencia-se a incorporação do discurso punitivista defendido pela população em geral no âmbito do sistema de justiça criminal, sendo reproduzido por seus representantes em decisões judiciais.
Resumo Inglês:
The demonstration of the incorporation of the punitive discourse by the Judiciary, as well as how this happened is what moves the present research. In order to do so, it will seek to identify the functions of the Judiciary and, specifically, the criminal justice system, in addition to observing whether these are fulfilled in the daily life of the system. Afterwards, it will be demonstrated the reasons that influenced in the judicial protagonism from the decade of the 80, and how this influenced in its performance. Finally, it will be evidenced the incorporation of the punitive discourse defended by the population in general within the criminal justice system, being reproduced by its representatives in judicial decisions.
