O objetivo deste texto é a observação teórico-descritiva de possíveis sintomas de dissonância sistêmica entre o sistema de direito e a política na Jurisdição Constitucional. Perspectivas de análise são colocadas a partir da teoria dos sistemas sociais autopoiéticos na Sociologia e na Sociologia do Direito. A judicialização da política e a politização do direito são investigadas. As conclusões são apresentadas.
The objective of this text is the theoretical-descriptive observation of possible symptoms of a systemic dissonance between the legal system and the political system in the Constitutional Jurisdiction. Analysis perspectives are presented based on the theory of autopoietic social systems in Sociology and Sociology of Law. The judicialization of politics and the politicization of law are investigated. Conclusions are presented.
