A teoria da Constituição Dirigente, desenvolvida por Canotilho, é muitas vezes utilizada, expressa ou implicitamente, para justificar os contornos atuais em que atua o STF, sobretudo em hipóteses de omissão legislativa. Nesse sentido, a teoria é objeto de muitas críticas, a partir da noção de que a Constituição Dirigente está necessariamente atrelada a uma série de escolhas sociopolíticas predeterminadas. Assim, este estudo tem por objetivo analisar, fundamentado na comparação entre duas Constituições Dirigentes de teor absolutamente diverso, se há e quais são as opções necessariamente atreladas à escolha do constituinte originário por uma Constituição Dirigente.

The theory of a Dirigent Constitution, elaborated by Canotilho, is utilized, either express or implicitly, to justify the scope of the Brazilian Supreme Court’s jurisdiction, especially in cases of Constitutional omission. In this sense, the theory is highly criticized based on the notion that the Dirigent Constitution is necessarily tied to a number of other pre-determined social and political options. So, this study aims to analyze, based on the comparison between the Brazilian and Cuban DIRIGENT Constitutions, if there are and what are the necessary social and political choices the original constituents have to make if they opt for a Dirigent Constitution.
