O dever dos pais de proverem o sustento dos filhos, enquanto incapazes, tem repercussões jurídicas, em especial quando o pai adquire nova prole e deseja reduzir a quantia paga aos outros filhos. A discussão jurídica sobre o tema esbarra em vários pontos, tais como: os direitos sexuais dos pais, a igualdade entre os genitores e entre os irmãos e também o papel do Poder Público em executar, com sucesso, políticas públicas de planejamento familiar. Mas, muito importante é o ator social Estado Juiz que decide a questão. Ao sentenciar, deve o magistrado ter em mente as repercussões sociais de sua sentença, posto que não está lidando apenas com papéis, mas decidindo vidas, o destino de pessoas que sofrem, que riem e cuja felicidade será influenciada pela decisão judicial.
