O presente texto versa sobre as transformações polÃticas, jurÃdicas e sociais que influÃram na constituição do aparato punitivo estatal brasileiro. Em especial, pretende refletir sobre aplicação da pena de prisão e suas transformações ao longo da história até o presente. Neste sentido, tendo como eixo analÃtico as diferentes dimensões do vivido e do prescrito, objetiva-se refletir sobre a relação entre a alternância de regimes polÃticos, do império à república, e seus efeitos no uso do aprisionamento enquanto instrumento punitivo central do sistema de justiça criminal brasileiro.
This paper analyzes the political, legal and social transformations that influenced the constitution of the Brazilian state punitive apparatus. In particular, it seeks to reflect on the application of prison sentences and their transformations throughout history to the present. In this sense, having as analytical axis the different dimensions of the lived and the prescribed, it aims at reflecting on the relationship between the alternation of political regimes, from empire to republic, and its effects in the use of imprisonment as a central punitive instrument of Brazilian criminal justice system.
