Desde a mais tenra Idade dos Homens, a escolha entre princípios concorrentes aparece como inarredável à condição humana. Transpondo essa lógica ao estudo de tribunais internacionais, Jeffrey Dunoff e Mark Pollack perscrutam as inextricáveis teias dos tradeoffs que os enrodilham, de maneira a aí observarem a gênese de um trilema: valores incompatíveis entre si, transparência, independência e accountability judicial não podem ser maximizadas a um só tempo; se um tribunal tiver altos níveis de dois desses valores, será a custo do inevitável sacrifício de um terceiro recurso. Sob essa ótica, os autores de O trilema judicial entendem que, em razão de maximizar a accountability e a transparência, uma ameaça sistêmica paira sobre a independência judicial da Corte Internacional de Justiça. Em uma análise crítica da obra, este artigo busca compreender se, de fato, a independência dos juízes encontra-se fragilizada na Corte. Para tanto, o Regulamento da Corte de 1978 e o caso contencioso Pulp Mills são trazidos a lume. Diante da investigação, conclui-se a impossibilidade de mensurá-la com exatidão, pois abarca variáveis que fogem à estatística — ao terreno do provável e do quantificável. A partir da descoberta de que o próprio trilema judicial engloba dilemas, evidencia-se que os conflitos com os quais Estados e juízes têm de lidar ante o design institucional dos tribunais escapam amiúde à análise pragmática pretendida pelos estudiosos. Se, para além do mito de Páris, pomos da discórdia são lançados em direção a esses atores a todo instante, as possibilidades de investigá-los serão inesgotáveis.

Since the dawn of time, the choice between competing principles has appeared as an inescapable characteristic of the human condition. Transposing this logic to the study of international courts, Jeffrey Dunoff and Mark Pollack scrutinize the tradeoffs that surround them, observing the genesis of a trilemma: incompatible values, transparency, accountability and judicial independence cannot be maximized at the same time; if a court has high levels of two of these values, it will be at the cost of the inevitable sacrifice of a third resource. From this perspective, the authors of The Judicial Trilemma understand that, because it maximizes accountability and transparency, judicial independence is subject to a systemic threat at the International Court of Justice. Based on a critical analysis of Dunoff and Pollack’s work, this article seeks to understand whether, in fact, the independence of judges is weakened at the Court. To this end, the 1978 Rules of the Court and the Pulp Mills contentious case are brought to light. Thus, it is concluded that it is impossible to measure it precisely, since it encompasses variables that are beyond the domain of statistics –the realm of the probable and the quantifiable. From the discovery that the Judicial Trilemma itself encompasses dilemmas, it becomes evident that the conflicts that States and judges have to deal with often escape the pragmatic analysis intended by scholars. If, beyond the myth of Paris, golden pomes are hurled at these actors all the time, the possibilities of investigating them are endless.
