O direito à educação é componente do mínimo existencial, indispensável à garantia do princípio da dignidade da pessoa humana e base para assegurar direitos fundamentais introduzidos no ordenamento jurídico pela Constituição Federal de 1988. Através de sua efetivação o indivíduo se torna senhor de sua consciência crítica, que o guiará por caminhos escolhidos livremente. A leitura enquanto instrumento essencial à realização da educação cumpre papel fundamental nessa formação do indivíduo, especialmente daqueles que estão expostos à situação de crise, como no caso da população carcerária. Nesse contexto surge a remição penal pela leitura, instrumento de política criminal e penitenciária tendente à efetivação do direito à educação do preso e promessa de prevenção especial positiva.
Resumo Inglês:
The right to education is a component of the existential minimum, indispensable for guaranteeing the principle of the dignity of the human person and a basis for securing fundamental rights introduced in the legal system by the Federal Constitution of 1988. Through its effectiveness, the individual becomes master of his critical conscience will guide you through freely chosen paths. Reading as an essential instrument for the realization of education has a fundamental role in this formation of the individual, especially those who are exposed to crisis situations, as in the case of the prison population. In this context, a criminal remission by reading, an instrument of criminal and penitentiary policy tending to the realization of the prisoner’s right to education and promise of positive special prevention.
