RESUMO Este artigo tematiza a efetividade dos direitos linguísticos. Tem-se como objetivo, alicerçado em reflexões em torno do campo interdisciplinar da Política Linguística, analisar tomadas de decisões judiciais envolvendo questões linguísticas que incidem e interferem no resultado de julgamentos. Nesse sentido, discute-se a efetividade dos direitos linguísticos. Para proceder à discussão, o trabalho foi realizado por meio de pesquisa bibliográfica e eletrônica, a partir das quais tecem-se considerações acerca do panorama de diversidade de línguas existente no Brasil e das políticas linguísticas internas do país, que incidem na perspectiva aqui defendida do respeito e promoção do multilinguismo. As análises e reflexões presentes no trabalho reiteram a importância e a necessidade de discussões em torno das ações de gestão de línguas na esfera jurídica, considerando que, em muitos casos, embora haja todo um conjunto de leis linguísticas e orientações nacionais e internacionais que versem sobre o tema, a questão dos direitos linguísticos ainda carece de discussão
Resumo Inglês:
The subject-matter of this article is the effectiveness of linguistic rights. The purpose of this study, based on reflections on the interdisciplinary field of Language Policy, is to analyze judicial decisions and discuss the language policy orientations that influence or even determine the outcome of the judgements, as well as the occurrence of violation of linguistic rights and disregard for linguistic plurality. In order to proceed with the discussion, the study was carried out through bibliographical and electronic research, from which considerations on Brazilian language diversity and its language policies are made. The analyzes and reflections reiterate the importance and the need for discussions on language management actions in the legal domain, considering that in many cases, although there is a whole set of international and national language laws and regulations on the subject, the issue of language rights is not appropriately considered.
