O presente trabalho trata do estudo do posicionamento do Superior Tribunal de Justiça a
respeito da incidência dos direitos fundamentais nas relações entre particulares. Analisa-se a
idéia de direito fundamental no ordenamento jurídico brasileiro e na doutrina pátria, a
fundamental participação do Superior Tribunal de Justiça na ordem jurídica do país antes de
mostrar as teorias sobre a eficácia de tais direitos no tráfico jurídico privado e a posição
firmada neste Tribunal.

Resumo Inglês:

This paper deals with the study of the attitude of the „Superior Tribunal de Justiça‟ regarding
the incidence of fundamental rights in relations between individuals. Analyze the idea of a
fundamental right in the Brazilian legal system and doctrine homeland, the vital participation
of the Superior Tribunal de Justiça in the law of the country before showing the theories about
the effectiveness of such trafficking in private legal rights and position in this Court signed.
