The question about whether the administrative precedent, that is the previous decision of the Administration on a similar and previous matter to which it is currently to be resolved, is a source of law or not, has raised different doctrinal opinions in Uruguay and the comparative law. In this work we compile the different positions to arrive, in short to our conclusion on a subject whose discussion does not end with it; on the contrary, the discussion is open not only on the conditioning that the existence of the precedent implies for the Administration, but also on the scope of the same even with respect to other Public Administrations.
Resumo Espanhol:
La cuestión acerca de si el precedente administrativo, o sea la decisión previa de la Administración sobre un asunto similar y anterior al que debe resolverse actualmente es o no fuente de derecho, ha suscitado diferentes opiniones doctrinarias en Uruguay y el derecho comparado. En este trabajo realizamos una compilación de las diferentes posiciones para arribar, en definitiva a nuestra conclusión sobre una temática cuya discusión no se agota con el mismo; por el contrario queda abierta la discusión ya no solo sobre el condicionamiento que supone para la Administración la existencia del precedente, sino sobre el alcance del mismo incluso respecto de otras Administraciones Públicas.
