Este artigo discute, essencialmente, a questão do encarceramento seletivo no Brasil. Reflexões recentes apontam que o Estado Brasileiro vem sofrendo, há pelo menos duas décadas, um visível enfraquecimento da democracia. A metodologia proposta nesse estudo consiste na análise de artigos científicos, de revistas e de livros que relacionam a hipertrofia do encarceramento no Brasil à tese do enraizamento do Estado Pós-Democrático neoliberal no país. Além disso, também se inclui na metodologia a coleta de dados socioeconômicos sobre a realidade carcerária brasileira, encontrados no endereço virtual do Departamento Penitenciário Nacional (Depen) e do Fórum Brasileiro de Segurança Pública. Nesse contexto, analisando essa fragilização das instituições democráticas no Brasil com atenção especial ao Poder Judiciário, é possível notar que o discurso que legitima esse sistema é também responsável pela dinâmica de seleção que encarcera os considerados indesejáveis à razão neoliberal. Indivíduos esses que, não por acaso, são identificados como os que sempre foram negligenciados pelo mesmo Estado que os pune com severidade.
This article discusses, mainly, the selective imprisonment ́s issue in Brazil. Recent reflections indicate that Brazilian State has been suffering, for at least two decades, a visible weakening of democracy. The suggested methodology in this paper consists of the analysis of scientific articles, journals and books that relate the hypertrophy of incarceration in Brazil to the thesis of the rooting of the post-democratic Neoliberal State in the country. In addition, it is also included in the methodology the gathering of socioeconomic data about the Brazilian prison situation, found in the virtual page of the Departamento Penitenciário Nacional (Depen) and of the Fórum Brasileiro de Segurança Pública. In this context, analyzing this weakening of democratic institutions in Brazil with special attention to the Judiciary, it is possible to notice that the discourse that legitimizes this system is also responsible for the dynamics of selection that imprison those considered undesirable to neoliberal reason. Individuals who, not by chance, are identified as those who have always been neglected by the same State that punishes them severely.
