Este artigo analisa criticamente a proteção do mínimo existencial do consumidor superendividado à luz da Lei n.º 14.181/2021, dos Decretos n.º 11.150/2022 e n.º 11.567/2023 e das ADPFs 1005, 1006 e 1097. Sustenta-se que a fixação de valores insuficientes compromete direitos fundamentais e afronta os princípios da dignidade da pessoa humana, da proteção ao consumidor e da vedação ao retrocesso social. Com base no Direito Constitucional, na doutrina e no Direito Comparado, conclui-se pela necessidade de revisão dos parâmetros infralegais vigentes.
This article critically examines the legal protection of the existential
minimum for over-indebted consumers, as provided by Law No.
14,181/2021, Decrees No. 11,150/2022 and 11,567/2023, and the
pending ADPFs (Actions for Failure to Comply with a Fundamental
Precept) 1005, 1006, and 1097 before the Brazilian Supreme Court. It
argues that the low regulatory thresholds undermine fundamental rights
and violate constitutional principles such as human dignity and consumer
protection,
and the prohibition of social retrogression. Drawing from

concludes that there is a need to revise the current normative framework.
