Esta pesquisa objetivou analisar os reflexos que o aprisionamento gera aos filhos das encarceradas no Brasil, bem como descobrir qual o perfil das mães aprisionadas e em quais condições elas sobrevivem nas prisões, estando longe de suas crianças. Ainda, buscou verificar a não observância ao direito de prisão domiciliar a essas mães e as dificuldades decorrentes dessa realidade. O método utilizado foi de revisão bibliográfica, ao explanar leituras, observando teorias, casos e percentuais. Conclui-se neste estudo, que a pena das aprisionadas deixa de ser individual ao acarretar diversas consequências a seus filhos. Por isso, para amenizar os problemas gerados por tal situação, deve-se tornar a prisão domiciliar mais acessível para essas mulheres, pois a não observância desse direito tem condenado muitos inocentes.
This academical research aimed to analyze the reflections that imprisonment generates to the children of female prisoners in Brazil, as well as to discover what is the social and family profile presented by these imprisoned mothers and also investigate what are the background conditions in which they survive in the prisons, especially considering the circumstance of them being away from their children. Further, it aimed to verify the institucional failure to comply with the right of house arrest to those mothers as well as the difficulties that arise from this. The method used in this research was the one of bibliographic review, exploring scientific readings, observing theories developed by specialists, study cases and statistical data. In this study it is concluded that the criminal sentences received by those female prisoners ceases to be individual by bringing various consequences to their children. Therefore, in order to alleviate the problems caused by such a situation, house arrest should be made more accessible to these women, because institucional failure to comply with this right has condemned many innocent mothers.
