Resumo Português:

A “entrega vigiada” no tráfico e contrabando internacional de pessoas, prevista na Convenção de Palermo, traz evidente conflito em relação à dignidade humana em face da discricionariedade da autoridade policial. O presente artigo tem por objetivo analisar, diante do permissivo da “entrega vigiada” de vítimas, prevista no Protocolo Adicional à Convenção de Palermo, em que medida é necessário que as autoridades permitam o risco à integridade física e/ou sexual de uma ou de algumas vítimas de tráfico e contrabando de pessoas em prol da obtenção de provas ou do melhor momento que justifique o retardamento da ação para o alcance de uma condenação substancial dos envolvidos ou que abranja maior número de delinquentes. Questiona-se se a integridade física e a dignidade sexual das vítimas submetidas à “entrega vigiada” têm recebido primazia em prol da pretensão de colheita da prova. Argumenta-se, ao final, que as autoridades, ao se utilizarem da “entrega vigiada” de vítimas, têm negligenciado a segurança e a dignidade da pessoa em prol da obtenção da prova, não provendo mecanismos efetivos que assegurem a integridade física e moral da pessoa humana durante as investigações de tráfico e contrabando de pessoas.



Resumo Inglês:

A “controlled delivery” in trafficking and international smuggling of persons allowed in the Palermo Convention brings obvious conflict with respect for human dignity due to the discretion of the police authority. This article aims to analyze, on the permissive of “controlled delivery” of victims under the additional protocol to the Palermo Convention, to what extent it is necessary that the authorities allow the risk to physical and/or sexual integrity of one or a few victims of trafficking and smuggling of people for the sake of obtaining evidence and the best time to justify the delay of action to achieve a substantial conviction of those involved or covering more offenders. the question arises whether the physical and sexual dignity of victims put in a position of “controlled delivery” have received primacy in favor of the proof of claim harvest. The final argument is that the authorities, by using the “controlled surrender” of the victims, have neglected the security and dignity of the person in the search of evidence, not providing effective mechanisms to guarantee the physical and moral integrity of the person during the investigations trafficking in human beings and smuggling of people.
