Este artigo aborda a evolução do direito à saúde nos Sistemas Regionais
de Proteção dos Direitos Humanos das Américas e da Europa. Para tanto,
contextualiza o amadurecimento do conceito e da exigibilidade do direito
à saúde em âmbito internacional. Na sequência, analisa a evolução desse
direito especificamente no âmbito da Corte Interamericana de Direitos
Humanos, destacando as suas diferentes fases de justiciabilidade. Logo
após, passa à análise da progressão da tutela do direito à saúde nas decisões
do Tribunal Europeu de Direitos Humanos. Ao final, busca destacar as
perspectivas e desafios atuais para a plena efetivação do direito à saúde,
em especial diante das crescentes denúncias de sua violação conectadas à
garantia do meio ambiente saudável e equilibrado.
his article addresses the evolution of the right to health in the Regional
Systems of Human Rights in the Americas and Europe. It contextualizes
the development of the concept and of the enforceability of the right to
health at an international level. Next, it analyzes the evolution of this right
specifically within the scope of the Inter-American Court of Human Rights,
highlighting its different phases of justiciability. Afterwards, it analyzes the
progression of the protection of the right to health in the decisions of the
European Court of Human Rights. In the end, it seeks to highlight the
current perspectives and challenges for the full realization of the right to
health, especially in view of the growing reports of its violation linked to
the guarantee of a healthy and balanced environment.
