O artigo pretende estabelecer uma interligação entre o modelo de funcionamento dos arquivos audiovisuais e sonoros e a diferente legislação produzida nos últimos anos em Portugal. Ao longo do texto, é analisada a principal legislação que regula o sector televisivo e radiofónico, encontrando-se referências ao papel do arquivo na gestão da informação e conservação do espólio histórico. Nessa perspectiva é focado o papel Código de Direitos de Autor e Direitos Conexos como principal instrumento jurídico no acesso aos registos sonoros e audiovisuais arquivados, sendo definido principais condicionalismos dessas instituições na utilização desse diploma legal. No final do artigo é mencionado algumas sugestões para a alteração do panorama legal que optimize o funcionamento destas organizações.
his paper aims to link the operating model of sound and audiovisual archives with the legislation on the subject produced by Portuguese governments in recent years. The paper reviews the main legislation regulating radio and television archives sector and also refers to public information general access and the preservation of heritage in sound and audiovisual archives. This perspective is explained on the role Code of Copyright and Related Rights as the principal legal instrument on access to sound recordings and audiovisual archive, which defined the main constraints of these institutions to use this legislation. At the end of the article is mentioned a few suggestions for changing the system legal that optimizes the operating model of these organizations.
