FAKE NEWS: UM ATENTADO ÀS LIBERDADES DE PENSAMENTO E CONSCIÊNCIA

O avanço tecnológico ocorrido a partir de 1950 em relação aos meios de comunicação inaugurou, de fato, a chamada sociedade da informação ou do conhecimento. Fronteiras geográficas foram transpostas, dando lugar à globalização e a troca de informações passou a influir significativamente em todos os setores da vida social. Evidentemente, o ser humano – mero meio de produção na sociedade industrial – passa a ser o centro das atenções, já que só este pode ser detentor de informações. A informação passou a ser o vetor que confere ao ser humano prestígio, identidade, pertencimento e poder, logo, a ideia de liberdade neste momento histórico orbitava em torno de promover o acesso e garantir a transmissão. Não tardou e a subversão veio nas asas da desinformação, por um instrumento modernamente chamado de fake news (notícias falsas), espalhadas para enganar, manipular o pensamento, a consciência e a expressão do destinatário, causando a este prejuízo ou proporcionando vantagem ao criador e/ou difusor das fake news. Há os que propugnam a legitimidade das fake news como exercício da liberdade de expressão, contudo, o seu caráter doloso voltado para o engano, a desfiguração conveniente da verdade a fim de manipular o comportamento do destinatário, a revelam como atentatória às liberdades de pensamento, consciência e à função social da liberdade de expressão, revestindo-as de ilicitude e urgindo a atuação do Direito para coibi-la.
Resumo Inglês:
The technological advances that look place since 1950 in relation to the means of communication in fact inaugurated the so-called information or knowledge society. Geographical borders were crossed, giving way to globalization and the exchange of information began to significantly influence all areas of social life. Evidently, the human being – a mere means of production in industrial society – becomes the center of attention, since only this person can hold information. Information became the vector that confers prestige, identity, belonging and power to human beings, therefore, the idea of freedom in this historic moment orbited around promoting access and guaranteeing transmission. Soon, subversion came on the wings of misinformation, by an instrument modernly called fake news, spread to deceive, manipulate the recipient’s thoughts, conscience and expression, causing this damage or providing an advantage to the creator and/or fake news broadcaster. There are those who advocate the legitimacy of fake news as an exercise of freedom of expression, however, their malicious character aimed at deception the convenient disfigurement of the truth in order to manipulate the recipient’s behavior, reveal it as an attack on freedom of thought and the social function of freedom of expression, covering them with illegality and urging the action of Law to curb it.
