O presente trabalho tem como escopo básico o reconhecimento da normatividade vinculativa e erga omnes das regras e princÃpios programáticos insertos na Constituição Federal de 1988, principalmente tendo em vista seus valores supremos e sua força normativa. As normas programáticas possuem, segundo o atual pensamento neoconstitucional, eficácia plena junto aos poderes Legislativo, Executivo e, principalmente, Judiciário, cabendo, portanto, a esse último sua real concretização. Possuindo, pois, força normativa, as normas-programas constitucionais compõe o bloco de constitucionalidade, servindo de parâmetro ao controle de constitucionalidade.
This work has the basic scope of recognition of the binding normativity and erga omnes of the programmatic rules and principles inserted on the Federal Constitution of 1988, focusing mainly in its supreme values and its normative force. The programmatic rules have, according to the current neoconstitutional thinking, full effectiveness along the Legislative, Executive and Judicial, mostly Judicial, so the real achievement of the programmatic rules is up to it. Owning, then, the normative force, the constitutional program-rules compose the block of constitutionality, serving as parameter for the control of constitutionality.
