Resumo Português:
A globalização e a transformação do constitucionalismo da sociedade mundial trouxeram novos dilemas de grande repercussão no direito internacional. No presente trabalho, busca-se, pela dogmática jurídica, sedimentar a construção doutrinária para o fenômeno da modernidade. Propõe-se uma leitura crítica dos estudos de Habermas na defesa da estrutura supranacional, esta, por sua vez, inspirada no diagnóstico de Immanuel Kant acerca da paz perpétua e da emancipação da humanidade. Na sequência, apresenta-se a inovadora doutrina de Gunther Teubner sobre a “nova questão constitucional”, cuja originalidade é traduzida na teoria constitucional da sociedade globalizada, em constante e progressiva fragmentação dos setores sociais de âmbito mundial. Ao final, o assentamento do tema na perspectiva de considerações analíticas do cenário vivenciado.

Globalization and the transformation of the word constitutionalism brought News dilemmas of great repercussion in the law. In the present work, it seeks the legal dogmatics doctrinal sediment to the phenomenon of modernity. Proposes a critical reading of the studies of Habermas in defense of supranational structure, this inspired in the diagnosis of Immanuel Kant about peace for emancipation of mankind. In the sequel, it presents the innovative theory of Gunther Teubner on “the new constitutional question” whose originality is translate into constitutional of social sectors of the world. In the end, the settlement of the issue from the perspective of analytics considerations of the scenario.
