Na decisão do Habeas Corpus 126.292/SP, o STF decidiu que é possível a execução da pena antes do trânsito em julgado da condenação criminal, a pesar de o inciso LVII do artigo 5º da Constituição Federal expressamente exigir o trânsito em julgado, fazendo com que muitos acreditem se tratar de mutação constitucional. Esse artigo analisa a decisão proferida no respectivo Habeas Corpus, sem adentrar o mérito da discussão, mas aborda outro ponto fundamental, qual seja, se o STF utilizou dos fundamentos de uma mutação constitucional, de uma hermenêutica constitucional ou se trata de uma decisão discricionária e arbitrária.

In the decision of Habeas Corpus 126,292 / SP, the STF decided that it is possible to execute the sentence before the final sentence of the criminal conviction, although section 5º of the Federal Constitution expressly requires a final with which many believe it is a constitutional mutation. This article analyzes the decision made in the respective Habeas Corpus, without going into the merits of the discussion, but addresses another fundamental point, that is, whether the STF has used the foundations of a constitutional mutation, a constitutional hermeneutic or is it a discretionary decision and arbitrary decision.
