This paper analyzes the legal and institutional framework of the financing of electoral campaigns ruled by the Law of Transparency, Boundary and Electoral Spending Control No. 19,884. To this end, it examines the types of financing, faculties and control mechanisms that the Electoral Service (SERVEL) can practice to ensure compliance with the rules of electoral spending and institutional guarantees that recognize a regulatory body and the conditions affecting both the fairness and efficiency of control. Finally, the paper describes the general process of income management and election expenses established by statute in regard to regulation, accountability and the corresponding sanction system.
El presente trabajo analiza el marco jurÃdico institucional del financiamiento de las campañas electorales regidas por la Ley Sobre Transparencia, LÃmite y Control del Gasto Electoral Nº 19.884. Con tal fin, examina los tipos de financiamiento, las atribuciones y mecanismos de control que el Servicio Electoral (SERVEL) puede ejercer para asegurar el cumplimiento de las normas del gasto electoral junto a las garantÃas institucionales que se reconocen al órgano fiscalizador y las condiciones que inciden tanto en la imparcialidad como en la eficiencia del control. Finalmente, el trabajo describe el proceso general del control de ingresos y gastos electorales que establece la norma legal en lo que respecta a fiscalización, rendición de cuentas y el correspondiente sistema sancionatorio
