Em consideração às demandas sociais das últimas décadas, a vulnerabilidade das populações indígenas perante as instituições sociais tem se tornado uma questão de grande pertinência na formulação de políticas públicas. Nesse âmbito, se destaca o atual dilema da acessibilidade digital como mecanismo de acesso ao Poder Judiciário para alcançar a promoção dos direitos inerentes a todos os indivíduos. Diante disso, faz-se pertinente apontar os dilemas enfrentados pela população indígena diante da vulnerabilidade tecnológica, visando compreender o fenômeno de exclusão digital a partir do âmbito regional. Com isso, propicia-se o questionamento a respeito da real acessibilidade ao âmbito jurídico no Estado do Amazonas diante da modernização dos tribunais na chamada Justiça 4.0. Para tanto, faz-se pertinente o levantamento de dados quantitativos e embasamento doutrinário a respeito da construção sociológica da problemática sob a perspectiva do pensamento jurídico, a fim de considerar soluções viáveis para a possível marginalização digital sofrida pelas comunidades tradicionais na Amazônia.
In consideration of the social demands of the last decades, the vulnerability of indigenous populations before social institutions has become an issue of great pertinence in the formulation of public policies. In this context, the current dilemma of digital accessibility stands out as a mechanism to access the Judiciary to achieve the promotion of rights inherent to all individuals. Therefore, it is pertinent to point out the dilemmas faced by the indigenous population in the face of technological vulnerability, aiming to understand the phenomenon of digital exclusion from a regional perspective. With this, the questioning of the real accessibility to the legal field in the State of Amazonas in face of the modernization of the courts in the so-called Justice 4.0 is propitiated. To this end, it is pertinent to survey quantitative data and doctrinal foundation regarding the sociological construction of the problem from the perspective of legal thought, to consider viable solutions to the possible digital marginalization suffered by traditional communities in the Amazon.
