A segregação das pessoas com deficiência sempre esteve presente na história da humanidade. O presente trabalho tem por objetivo central realizar um estudo das reflexões sobre os direitos do homem pela perspectiva do filósofo italiano Norberto Bobbio, com ênfase em sua obra A era dos direitos, relacionando-a com a Convenção sobre os Direitos das Pessoas com Deficiência e o Estatuto da Pessoa com Deficiência, sob o viés da inclusão social. Embora questões envolvendo a deficiência no ser humano não sejam recentes, a discussão sobre a proteção dos direitos fundamentais e principalmente a efetividade desses direitos se mostra atual e de grande valia, pois se observa a necessidade de elaboração e execução de políticas públicas que visem o reconhecimento dos direitos e principalmente a sua efetivação. A abordagem acerca do tema leva em consideração a inclusão social das pessoas com deficiência e especialmente o papel do Estado em proporcionar o direito à igualdade, que é a base para oportunizar e de fato efetivar o acesso à inclusão social dos grupos minoritários. Foi utilizada a metodologia dedutiva, por intermédio de levantamento bibliográfico das obras do autor, sem a pretensão de colocar fim à discussão.

The segregation of people with disabilities has always been present in the history of humanity. The main objective of this work is to study human rights from the perspective of the Italian philosopher Norberto Bobbio, with emphasis on his work The age of rights, relating it to the Convention on the Rights of Persons with Disabilities and the Statute of the Person with Disabilities under the bias of social inclusion. Although human disability issues are not recent, the discussion on the protection of fundamental rights and especially the effectiveness of these rights is current and of great value, since it is observed the necessity of elaboration and execution of public policies aimed at the Recognition of rights and, in particular, their realization. The approach to this theme takes into account the social inclusion of people with disabilities and especially the right to equality, which is the basis for opportunizing and effective access to social inclusion for the minority classes. The methodology used was hypothetic-deductive, through a bibliographical survey of the author’s works, without the pretension of putting an end to the discussion.
