A INCLUSÃO SOCIAL DAS PESSOAS COM DEFICIÊNCIA, SOB O VIÉS DA PROTEÇÃO UNIVERSAL DOS DIREITOS HUMANOS

Resumo Português:

O artigo aborda a problemática vivenciada pelas pessoas
com de ciência, para poderem ser incluídas na sociedade,
apesar da existência do grandioso rol de direitos contemplados
àquela categoria de pessoas, tornando-se, não raras vezes,
inócuos, face à impossibilidade de efetivação dos mesmos. Para
frisar a responsabilidade do Estado brasileiro, demonstra que o
mesmo consta como um dos países signatários de instrumentos
internacionais, tais como a Convenção Internacional dos Direitos da
Pessoa com De ciência, comprometendo-se formalmente, em zelar
pelo rechaçamento de tratamento preconceituoso e discriminatório
às pessoas com de ciência. Estabelece como contraponto do estudo,
a di culdade para a efetivação dos direitos humanos, esclarecendose
que o reconhecimento do respeito aos direitos das pessoas com
de ciência, mediante elevação à seara dos Direitos Humanos, ainda
não se tornou su ciente, para afastar as freqüentes afrontas aos
direitos fundamentais desta categoria de pessoas, fator para o qual
deve-se chamar a atenção dos familiares, da sociedade e do Estado
brasileiro, na pessoa de seus governantes, a  m de adotar medidas
urgentes, modi cadoras deste panorama, antes que se implementem
irreversíveis violações à dignidade humana destas pessoas, denotando
verdadeiros desastres a registrarem-se negativamente na história dos
direitos humanos.

Resumo Inglês:

The article discusses the problems experienced by people
with disabilities for inclusion in society, despite the existence of the
grand list of rights provided to that category of people, becoming,
often, innocuous, given the impossibility of making the same. To
emphasize the state’s responsibility, demonstrates that it is listed
as one of the signatories to international instruments such as the
International Convention on the Rights of Persons with Disabilities,
formally committing themselves, in ensuring that the rejection of
discriminatory and prejudicial treatment to people with disabilities.
Establishing a counterpoint of the study, the dif culty for the
realization of human rights, stating that the acknowledgment and
respect the rights of persons with disabilities by raising the harvest
of Human Rights, has not yet become enough to dispel the frequent
affronts to fundamental rights of this category of people, a factor
to which we should draw the attention of family, society and the
Brazilian State in the person of their rulers, to take urgent measures,
modifying this outlook, which are implemented before irreversible
violations human dignity of these people, showing real disasters to
register negatively in the history of human rights.
