O objetivo deste artigo é explicar que, embora haja certa polêmica na sociedade a respeito do estudo de gênero, de sexualidade e de diversidade sexual nas escolas, eventuais leis que proíbem a discussão desses temas em sala de aula são manifestamente inconstitucionais. Ademais, elas utilizam o Estado para perpetuar a discriminação e o preconceito contra grupos sociais estigmatizados na sociedade brasileira, bem como para impedir a superação de imperativos morais excludentes, violando, por essa razão, os objetivos fundamentais da República Federativa do Brasil e o princípio do regime democrático.
Resumo Inglês:
The aim of this article is to explain, although there is a certain controversy in the society about the possibility of Gender Studies, Sexuality Studies and Sexual Diversity Studies in schools, possible laws that prohibit teachers from discussing these themes in the classroom are manifestly unconstitutional. Furthermore, they use the State to perpetuate the discrimination and the prejudice against the stigmatized groups in Brazilian society, as well as preventing the people from overcoming the excluding moral imperatives, violating, for that reason, the fundamental objectives of the Federative Republic of Brazil and the principle of democratic regime.
