A regulação estatal pode ser tanto hetero como autorregulação e existiram ao longo da história inúmeras pessoas jurídicas incumbidas de realizar a atividade administrativa regulatória decorrente desta função. O objetivo deste trabalho é analisar quais são as principais pessoas que possuem incumbência da atividade administrativa regulatória. Para tanto, estabeleceu-se como hipótese da pesquisa a afirmação de que não apenas as agencias reguladoras regulam o mercado. Para atingir tal objetivo, fez-se, a princípio, uma análise relativa a regulação como forma de intervenção do Estado, para em seguida estabelece o conceito técnico-jurídico de regulação. Após definir regulação, delimita-se tal concepção a atividade administrativa regulatória para só então tratar daqueles que tem incumbência desta atividade regulatória. Conclui-se identificando que a incumbência da atividade regulatória hoje recai, principalmente, sobre o ente estatal incumbido da prestação da atividade, à Administração Direta e as autoridades reguladoras independentes: agências reguladoras.

State regulation can be both hetero or self-regulating and throughout history there have been numerous legal entities tasked with performing the regulatory administrative activi-ty arising from this function. The objective of this paper is to analyze who are the main people who are responsible for regulatory administrative ac-tivity. Therefore, the research hypothesis was es-tablished that is not only the regulatory agencies who regulate the market. ln arder to achieve this goal, an analysis of regulation was initially made as a form of state intervention, and then the tech-nical-legal concept of regulation was established. After defining regulation, such conception is delimited to regulatory administrative activity to only then address those that are in charge of this regulatory activity. lt concludes by identify-ing that the task of regulatory activity today lies mainly with the state entity responsible for pro-viding the activity, the Direct administration and the independent regulatory authorities: the regu-latory agencies.
