The aim of this article is to analyze the “best interests of the childâ€, with basis on the recognition of the human rights of the underage. To this end, we have taken as a starting point the Convention on the Rights of the Child and its incorporation into the State law, taking into account the updating carried out by recent legislative reforms. In order to relate it to real life and the different ways of understanding this principle, we focus on assessing and determining the best interests of the child in the context of a marital crisis, and the criteria adopted in recent decisions by the Supreme Court.

El objetivo de este artÃculo es analizar el “interés superior del niñoâ€, desde el reconocimiento de los derechos humanos de las personas menores de edad. Para ello hemos tomado como punto de partida la Convención sobre los Derechos del Niño, y su incorporación al ordenamiento jurÃdico estatal, teniendo en cuenta la actualización llevada a cabo por las recientes reformas legislativas. Para relacionarlo con la vida real, y las diferentes formas de entender este principio, nos centramos en la evaluación y determinación del interés superior del niño en el contexto de una crisis matrimonial y de los criterios adoptados en recientes decisiones judiciales del Tribunal Supremo.
