O presente trabalho tem por objetivo analisar o documentário “Indianara”, o qual retrata o trabalho desempenhado por Indianarae Alves Siqueira, uma das idealizadoras da “Casa Nem”. A instituição acolhe pessoas trans em situação de vulnerabilidade no Rio de Janeiro e lhes fornece moradia, alimentação e tantos outros direitos cuja competência deveria ser do Estado. Assim, a partir da referida obra, a presente pesquisa busca refletir acerca da interface jurídica das situações narradas do longa documental, especialmente no tocante à prostituição e regulamentação do direito ao nome das pessoas trans. Serão demonstradas ainda a evolução lenta e tardia dos direitos das pessoas trans em nosso ordenamento jurídico, bem como as estatísticas de violência e homicídio contra as pessoas trans no Brasil. O método de estudo utilizado é o hipotético dedutivo, bem como o levantamento de bibliografias relativas ao tema, jurisprudências e dados estatísticos. As pessoas trans no país encontram-se em situação de extrema marginalização e a adoção de políticas públicas específicas é medida urgente a ser adotada pelo Estado Brasileiro.
The present work aims to analyze the documentary “Indianara”, which portrays the work performed by Indianarae Alves Siqueira, one of the creators of “Casa Nem”. The institution welcomes trans people in vulnerable situations in Rio de Janeiro and provides them with housing, food and many other rights that should be the responsibility of the State. During the research, statistics on violence and homicide against transgender people in Brazil will be demonstrated, associated with the analysis of the legal interface of the situations narrated in the feature film, especially with regard to prostitution and regulation of the right to a name for transgender people. The study method used is the deductive hypothetical, as well as the survey of bibliographies related to the theme and statistical data. Trans people in the country are in a situation of extreme marginalization and the adoption of specific public policies is an urgent measure to be adopted by the Brazilian State.
