O objetivo do presente trabalho é, de modo simples e acessível, introduzir os principais conceitos, noções e cuidados para guiar a escolha de smart contracts sob uma perspectiva negocial e jurídica. Assim, este trabalho será dividido em duas partes. Na primeira, é discutida a definição de smart contract e as tecnologias e termos relacionados. Essa seção contextualiza o tema de modo abrangente apresentando de modo simples os principais aspectos técnicos das tecnologias atreladas a smart contracts. Na segunda parte, são discutidas as vantagens e desvantagens de smart contracts, ou seja, a seção apresenta os maiores atrativos da tecnologia, expondo também suas limitações de modo a guiar a escolha (ou não) de smart contracts em determinado acordo.
The objective of this work is, from a business and legal perspective and in a simple and accessible way, to introduce the main concepts related to smart contracts and to provide a simple guide to help with the decision of whether to use this technology. Thus, this work will be divided into two parts. In the first one, the definition of smart contracts and its related technologies and terms are discussed. This section contextualizes the topic in a comprehensive way, presenting in a simple way the main technical aspects of smart contracts’ technologies. The second chapter discusses the advantages and disadvantages of smart contracts, that is, it presents the major benefits of the technology, also exposing its limitations in order to guide the choice of whether or not to use a smart contract for a certain agreement.
