A inversão do ônus da prova em processos individuais que decorrem de infrações ambientais é passível se ser deferida, quando se faz uma interpretação teleológica e desde que se observem alguns elementos e critérios. O primeiro é a equivalência do autor a consumidor equiparado estando sob a égide do direito do consumidor pos-sibilitando a inversão. O segundo elemento é a hipossuficiência do autor, bem como a verossimilhança da alegação. Os princípios, norteadores do direito ambiental, da prevenção e precaução, bem como principio do poluidor-pagador também servem de auxiliares para que seja requerida e deferida a inversão do ônus da prova.
Resumo Inglês:
The inversion of the proof responsibility in the individual processes that elapse of ambient infractions is possible of being granted, when a teleologic interpretation is done and since some elements and criterions are observed. The first one is the equivalence of the author to equalized consumer being under safeguards of the consumer’s right making possible the inversion. The second element is the “hypo sufficiency” of the author, as well as the probability of the allegation. The principles, which give to the north of the environmental law of, the prevention and precaution, as well as the principle of the polluting agent-payer also serves as assistant so that the inversion of the proof responsibility is required.
