Objetiva este artigo enfocar o impacto do sistema interamericano de direitos humanos na composição de um ius constitutionale commune latino-americano. Considerando o contexto social e político latino-americano, será estudado inicialmente o impacto transformador do sistema interamericano na região, a partir de uma tipologia de casos emblemáticos da jurisprudência da Corte Interamericana. À esta análise soma-se o exame do crescente empoderamento do sistema interamericano e sua força catalizadora na região, fruto da efetividade do diálogo jurisdicional em um sistema multinível. Por fim, pretende-se avaliar o impacto do sistema interamericano na pavimentação de um ius constitutionale commune latino-americano em matéria de direitos humanos, com ênfase em seus riscos, potencialidades e desafios.
The main purpose of this paper is to focus on the impact of the inter-american system in the creation of a Ius Constitutionale Commune in Latin America. In the light of the social and political latin-american context, the paper will study the transformative impact of the inter-american system on the region, adopting a tipology of emblematic cases from the jurisprudence of the Inter-American Court. In addition, the paper will deal with the growing empowerment of the inter-american human rights system and its special impact in the region, which derives from a judicial dialogue in a multi level legal system. Finally, the study intends to evaluate the impact ot the inter-american system in the consolidation of a ius constitutionale commune in Latin America in human rights, emphasizing its risks, potencialities and challenges.
