O uso do processo judicial trabalhista como fonte histórica tem crescido nesta segunda década do século XXI. Trata-se de documento com uma composição de peças, linguagem técnica e ritos próprios da prática processual sobre o qual busca-se aqui explorar algumas possibilidades de tratamento hermenêutico a fim de viabilizar o descortinar de aspectos que tragam para a abordagem historiográfica os chamados “de baixo” não só para expor sua condição de excluídos, mas como sujeitos históricos que interferem nas transformações sociais – entre elas a produção de normativos legais reguladores dos mundos do trabalho – com uma diversidade de protagonismos que nem sempre se situam diretamente na ação coletiva, no movimento social, mas são de interesse comum e tem impacto nas conquistas coletivas e na forja dos direitos sociais a partir da exigência de melhores condições de trabalho e respeito à dignidade humana.
The use of the labor court process as a historical source has grown in this second decade of the 21st century. This is a document with a composition of parts, technical language and rites specific to the procedural practice of Law on which we seek here to explore some possibilities of hermeneutic treatment in order to enable the uncovering of aspects that bring to the historiographical approach the so-called “from below” not only to expose their condition as excluded, but as historical subjects who interfere in social transformations – among them the production of legal regulations regulating the worlds of work – with a diversity of protagonists that are not always directly situated in collective action , in the social movement, but they are of common interest and have an impact on collective achievements and the forging of social rights through the demand for better working conditions and respect for human dignity.
