Este artigo pretende mostrar que os animais não podem ser considerados sujeitos de justiça, embora mereçam proteção moral derivada da compaixão humana. Para tanto, estabelece um diálogo com a obra do filósofo Ernst Tugendhat, analisando, a partir de conceitos por ele desenvolvidos, o argumento e a possível contradição dos defensores dos direitos dos animais.

This paper intends to show that animals cannot be considered as subjects of justice, although deserve moral protection derived from human compassion. For this establishes a dialogue with the work of the philosopher Ernst Tugendhat, analyzing through the concepts that he developed the argument and the possible contradiction of the defenders of animal rights.
