When faced with the signing of International Treaties or Conventions, most of the compared legal systems have armonically set forth preventive control models for International Treaties. In Spain (under Article 95.2 of the Spanish Constitution) the Government and one or the other of both Chambers may request the Constitutional Court to make a DECLARATION relating to the existence or inexistence of contradiction between the Treaty and the Constitution. This DECLARATION a) is made following a procedure regulated by the Constitutional Court Organic Law, articles 78 and following and b) said DECLARATION in some cases can act as an advancement for a reform of the Constitution and in other cases to avoid the signing of the Treaty. Apart from this preliminary control we study the possible existence of a later control which will be exercised through unconstitutional procedures and therefore the scope of res judicata should be investigated.
Resumo Espanhol:
Ante la firma de Tratados o Convenios Internacionales, la mayor parte de los sistemas comparados, han instaurado armónicamente modelos de control preventivo de los Tratados Internacionales. En España (según el art. 95.2 de la Constitución Española) el Gobierno o cualquiera de las Cámaras, pueden requerir al Tribunal Constitucional para que emita una DECLARACIÓN acerca de la adaptación de un Tratado a la Constitución. Esta DECLARACIÓN: a) se emite después del seguimiento de un procedimiento que se regula en la Ley Orgánica del Tribunal Constitucional, artículo 78 y siguientes; b) la referida DECLARACIÓN puede actuar en algunas ocasiones como previsión para la reforma de la Constitución, y en otras ocasiones para la no suscripción del Tratado. Junto a este control previo se estudia la posible existencia de un control posterior que se seguiría a través de los procedimientos de inconstitucionalidad y, por tanto, se tratará de investigar el alcance de la cosa juzgada.
