In the managerial Spanish fabric an especially important place occupies the family Enterprise –in the modality of small and medium Company (PYME)-. To need to guarantee his conservation and continuity before the death of the founding partner and his manifestation in juridical successor instruments as the delegation of the distribution of the inheritance for the spouse (article 831 of the Civil Code) and the distribution of the goods realized by the testator (article 1056 of the Civil Code) it is the matter object of analysis in the present study.

En el tejido empresarial español ocupa un lugar especialmente importante la empresa familiar – sobre todo en su modalidad de pequeña y mediana empresa (PYME)-. La necesidad de garantizar su conservación y continuidad ante el fallecimiento del socio fundador y su plasmación en instrumentos jurídicos sucesorios como la delegación de la facultad de mejorar (artículo 831 del Código Civil), y la partición realizada por el testador (artículo 1056 del Código Civil) es la materia objeto de análisis en el presente estudio.
