Objectives:The loss of opportunity is a term used by the Spanish jurisprudence in the health field, and that despite being a very widespread doctrine presents doubtful aspects in the requirements to grant compensation and the configuration of the damage, specifically, in the medical-sanitary civil liability claims.Methodology:This study analyzes the origin and the perspectives that deal with the loss of opportunity in order to solve the problem that constitutes the causal relationship between the activity of a subject and the damage produced. Different cases in which this theory is applied will be reviewed to know its importance and evolution.Results:This theory arises to unite uncertainty and certainty as opposing elements and that coexist in this type of situation, due to not knowing what would have happened if the patient had been adequately treated at the corresponding moment, and the certainty of the loss of expectations. for not having received the appropriate treatment at the right time.Conclusions:It emphasizes the difficult treatment for the application of the loss of opportunity technique, requiring for its application the causal uncertainty together with the pre-existence of an ideal situationto obtain a benefit or advantage that has not occurred. The connection between the two will enable the application of the loss of opportunity or expectations, determining the calculation of the compensation in a motivated manner by the Courts based on theprobability of the loss of opportunity.
Objetivos:La pérdida de oportunidad es un término utilizado por la jurisprudencia española en el ámbito sanitario, y que a pesar de ser una doctrina muy difundida presenta aspectos dudosos en los requisitos para conceder la indemnización y la configuración del daño, en concreto, en las reclamaciones de responsabilidad civil médico-sanitaria.Metodología:El presente estudio analiza el origen y las perspectivas que tratan la pérdida de oportunidad con el fin de solucionar el problema que constituye la relación causal entre la actividad de un sujeto y el daño producido. Se revisarán distintos casos en los que se aplica esta teoría para conocer su importancia y evolución.Resultados:Esta teoría surge para unir la incertidumbre y la certeza como elementos contrapuestos y que coexisten en este tipo de situaciones, por no saber qué habría ocurrido si el pacientehubiera sido tratado adecuadamente en el momento correspondiente, y la certeza de la pérdida de expectativas por no haber recibido el tratamiento oportuno en el momento adecuado. Conclusiones:Enfatiza el difícil tratamiento para la aplicación de la técnica de pérdida de oportunidad, requiriendo para su aplicación la incertidumbre causal junto con la preexistencia de una situación ideal para obtener un beneficio o ventaja que no se ha producido. La conexión entre ambos posibilitará la aplicación de la pérdida de oportunidad o de expectativas, determinando el cálculo de la indemnización de forma motivada por los Tribunales en función de la probabilidad de la pérdida de oportunidad
