Since the Spanish legislator in 2003, created the legal figure of Protected Heritage for people with disabilities. As is known, the law cannot be static, therefore, the Spanish legislator modified the Protected Heritage through Law 8/2021, of June 2, which reforms the civil and procedural legislation to support the people with disabilities in the exercise of their legal capacity giving this rule more freedom to people with disabilities for the creation of their Protected Heritage, in the same way to parents, guardians, curators and people for any legitimate interest on the person with disabilities. Therefore, it is a protection system for the vital needs of the disabled person when the parents or relatives are not in this life. Which implies that, in order to create Protected Heritage, the disabled person must comply with disability standards through Law 41/2003, of November 18, on the patrimonial protection of people with disabilities and the modification of the Civil Code, of the Civil Procedure Law and Tax Regulations for this purpose.
Puesto que el legislador español en el año 2003, creó la figura jurídica del Patrimonio Protegido para las personas con discapacidad. Como se sabe el derecho no puede estar estático por lo cual, el legislador español modificó el Patrimonio Protegido a través de la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para la el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica, dando esta norma más libertad a la personas con discapacidad para la creación de su Patrimonio Protegido, del mismo modo a los padres, tutores, curadores y personas por cualquier interés legítimo sobre la persona con discapacidad. Por lo que, es un sistema de protección para las necesidades vitales de la persona discapacitada cuando los padres o, familiares no estén en esta vida. Lo que implica que, para crear el Patrimonio Protegido, debe la persona discapacitada cumplir con los estándares de discapacidad mediante la Ley 41/2003, de 18 de noviembre, de protección patrimonial de las personas con discapacidad y de modificación del Código Civil, de la Ley de Enjuiciamiento Civil y de la Normativa Tributaria con esta finalidad.
