LE PRINCIPE DE NON REGRESSION “AU CŒUR” DU DROIT DE L’HOMME A L’ENVIRONNEMENT

Apesar do avanço do direito ambiental presente em diversas constituições
como um direito humano e fundamental, observam-se movimentos em diversos setores
sociais, polÃticos e econômicos que afrontam conquistas jurÃdicas colocando em risco a
proteção ambiental. EM muitos casos a doutrina especializada considera estes retornos
ao passado como retrocessos nos nÃveis de garantias dos direitos fundamentais. O
presente artigo busca sustentar a hipótese de fundamentação do princÃpio da proibição de
retrocesso ambiental a partir do reconhecimento do direito ao meio ambiente como direito
humano. Por meio de revisão bibliográfica e de decisões judiciais, a pesquisa emprega o
método dedutivo com aporte no estudo do direito comparado para demonstrar diversos
fundamentos teóricos, constitucionais, legais e jurisprudenciais que sustentam a hipótese
principal defendida, de maneira a permitir a aplicação de um princÃpio geral que proibe o
retrocesso de garantias em direitos humanos especificamente para o domÃnio ambiental.

Despite the advancement of environmental Law in several constitutions
as a fundamental human right, it can be observed movements in various social, political
and economic sectors that confront legal achievements endangering environmental
protection. In many cases, the specialized doctrine considers these returns to the past as
setbacks in the levels of guarantees of fundamental rights. This article seeks to support the
hypothesis of the principle of prohibition of environmental retrogression, understanding
the recognition of the right to environment as a human right. Through literature review
and judicial decisions, the research uses the deductive method with contribution of the
study of comparative law to demonstrate several theoretical, constitutional, legal and
jurisprudential foundations that support the main hypothesis defended, in order to allow
the general principle that prohibits the regress guarantees in human rights specifically for
the environmental domain.
